Trial date rescheduled for class action suit

The trial date for the class action lawsuit against the Ramona Municipal Water District has been rescheduled to Oct. 30, according to the San Diego Superior Court.

Residents who receive sewer service from the water district recently received notices of the class action suit, stating a June 19 trial date. The trial date was rescheduled April 22.

Attorney Todd Carpenter with the Carpenter Law Group that is representing the plaintiffs said RMWD requested a continuance to October.

The change, he said, will give “both sides time to prepare for trial because we’re on a pretty tight schedule.”

The lawsuit claims that RMWD’s sewer service charges, determined by equivalent dwelling unit (EDU) value, are not based on the proportional cost of providing a property with sewer service and is in violation of Proposition 218.

The Ramona water district contends its sewer service charges are proportional and fair, and calculated using a rational and reasonable system.

The lawsuit was filed on behalf of Eugene Plantier, who owns commercial property in Ramona, and Progressive Properties Incorporated and Premium Development LLC, based in Ramona. The Patterson Law Group of San Diego is also representing them.

Procopio Cory Hargreaves & Savitch LLP has been retained to represent the water district.

The suit pertains to Ramona water district customers who have paid a sewer service charge on or after Nov. 22, 2012, and the plaintiffs are seeking refunds of EDU-based sewer charges.
