Winery ordinance legal challenge ends

The legal challenge to the county’s tiered winery ordinance appears to be over and boutique winery owners can rest easier knowing the regulations that allow them to open tasting rooms still stand.

On Oct. 3, the fourth Appellate Court posted “case complete” in the San Diego Citizenry Group versus County of San Diego docket.

The citizenry group had an opportunity to appeal a ruling by the State of California Court of Appeals in late July that affirmed a lower court’s ruling in favor of the winery ordinance. The case stemmed from the citizenry group’s appeal of its 2011 environmental challenge to the county ordinance.

“It appears that the appeal window has now closed, since the court has taken this action. Case over,” James O’Day, senior deputy, Office of County Counsel stated in an email.

Since the tiered winery ordinance went into effect in August 2010, approximately 23 wineries in the Ramona area have opened tasting rooms or patios.
