Ramonan gets 11 years for using rifle in attempted robbery

A Ramona man who tried to rob the Ramona Chevron Food Mart with a rifle in 2009 has been sentenced to 11 years and four months in state prison.

Bud Henry Shelton, 22, was given credit for already serving 442 days in jail and a $2,000 fine by El Cajon Superior Court Judge Peter Deddeh on May 11.

Shelton was on probation for another robbery when the attempted robbery at Chevron occurred.

“The court has no choice with the gun allegation in that it carries 10 years,” said Deputy District Attorney Luis Mendez.

Deddeh imposed 10 years for using the rifle in the crime and added one year and four months for the attempted robbery. Shelton pleaded guilty March 14 to assault with a firearm and attempted robbery. He was arrested in April 2010 for the incident that occurred on Oct. 16, 2009, in the business at 802 Main Street. Shelton entered the store with a relative’s rifle and had a T-shirt with eye holes cut into it over his face.

He struggled with the clerk, Jose Moreno, and bit him on his thumb. During the struggle, Moreno took the rifle away from Shelton, who left the station without any money and lost the rifle.

Mendez said Shelton took off the T-shirt he used as a mask about a block away. Sheriff’s deputies found it, and his DNA was found on the shirt. Charges were not filed until after results of the DNA test were known.

Shelton was placed on three years probation on Dec. 7, 2009, for a robbery on Rosecrans Street in San Diego. He had received a suspended sentence of one year in jail and an $800 fine.

Shelton also has a prior conviction for possession of heroin and was sentenced in October 2009 to perform 50 hours of volunteer work on terms of three years probation, state court records.
